Taarak Mehta Ka Ooltah Chashmah: Unauthorized Use of Content from the Asit Kumar Modi Show Banned by Delhi HC

Taarak Mehta Ka Ooltah Chashmah has become a cultural phenomenon in India, whether you are a fan or not. The show stands as the longest-running TV show in Indian history and over the years has enabled an entire ecosystem that exists even outside the sets and the show. There are people mimicking these characters, memes, merchandise being sold with creatives from the show, AI tools being used to give this show a new life (not official, of course), and even pornography. So, there is an entire business running in the name of TMKOC. Turns out the makers are not happy with this, and Neela Film Productions has moved to the Delhi High Court to stop this and put a ban on the infringement of their rights. The HC has obliged and ordered a decision in favor of the makers.
Taarak Mehta Ka Ooltah Chashmah Makers Get Delhi HC’s Support
For the uninitiated, Neela Film Productions, the producers of Taarak Mehta Ka Ooltah Chashmah, told the Delhi High Court that their show’s title, dialogues, characters, and other intellectual properties are owned by them. They brought to the court’s notice that several websites, channels, and social media accounts were infringing on these rights. The production house further explained how the content is being used to sell unauthorized products, creative animations, videos, deepfakes, and even pornographic content.
The Delhi HC heard the plea of the Taarak Mehta Ka Ooltah Chashmah makers and gave out an order that was in favor of Neela Film Productions. Agreeing with the fact that the production house does have a very strong case in this matter, the court ordered an injunction. While Advocate Mamta Rani Jha and colleagues represented Google’s defense, Advocates Pravin Anand and others represented Neela Film Productions.
According to Bar and Bench, the court orders read, “An order of ex parte ad-interim injunction is passed thereby restraining the defendant nos. 1 to 12 and 14 to 21, (including the John Doe parties), their owners, partners, proprietors, officers, servants, employees, and all others in the capacity of principal or agent, acting for and on their behalf or anyone claiming through by or under it, from in any manner, hosting, streaming, broadcasting, transmitting, exhibiting, making available for viewing and downloading, providing access to and communicating to the public displaying, uploading, modifying, publishing, updating, sharing (including to its subscribers and users), offering for sale on their websites, through the internet, or in any manner or platform whatsoever, any content, goods or services, that in any manner whatsoever, amounts to infringement/passing off, of the plaintiff’s copyrighted material/registered trademarks, including, but not limited to the title, the Characters, Format and Underlying Materials in the said show or anything else, which otherwise amounts to an infringement of the plaintiff’s Copyright/registered trademarks/passing off of the goods/services offered by the defendants.”

Taarak Mehta Ka Ooltah Chashmah is always in the headlines for one reason or another. Most recently, we saw Kush Shah quit the show, and that made headlines. Shah played the popular child character Goli on the show. Before that, Gurucharan Singh, aka former Roshan Singh Sodhi, went missing for a month and returned post that. Even he had accused the makers of replacing him back in 2012 without his knowledge. He clarified that he did not quit the show.
