Indian Express, and NDTV Collaborate with ANI to Challenge OpenAI's Practices

An association of Indian news publishers, including the digital division of the Indian Express (IE Online Media Services Private Limited), NDTV Convergence, and the Digital News Publishers Association (DNPA), submitted an intervention application on Monday to the Delhi High Court regarding the lawsuit filed by ANI against OpenAI, the creator of ChatGPT.
It is important to note that the Times group, a member of the DNPA, is not involved in this intervention application. What is the objective of this collective? The association seeks to present its case in the proceedings, contending that the legal precedent set by ANI's lawsuit could have a substantial impact on the processes of news gathering and distribution.
This development follows closely on the heels of the Federation of Indian Publishers (FIP), which includes notable members such as Penguin Random House, Bloomsbury India, Wiley India, Pan Macmillan India, and Rupa Publications, expressing its desire to join ANI's lawsuit against OpenAI.
ANI's Lawsuit
ANI, a prominent news agency, has initiated legal proceedings against OpenAI, a leader in generative AI technology, claiming that it has utilized its "original news content" without proper authorization. The agency asserts that OpenAI incorporated its material to train its Large Language Models (LLMs), resulting in ChatGPT, the AI bot derived from these models, reproducing ANI's content verbatim in response to user inquiries.
In its legal complaint, ANI expresses concern that OpenAI's "hallucinations" could lead to misinformation, representing a significant risk. Furthermore, ANI contends that OpenAI has misattributed statements and news items to the agency that are either fabricated or do not exist.
DNPA's Says Indian News Industry To Be Affected
DNPA claims in its application that OpenAI infringes upon Intellectual Property (IP) rights by utilizing content from member websites without obtaining consent, licenses, or any form of authorization. The application further contends that such actions will adversely affect the entire Indian news sector and the journalists working within it.
Additionally, DNPA highlighted that its members consistently encounter difficulties presented by large technology companies, particularly in their efforts to monetize news content while lacking adequate compensation for the original creators of the news.
This Isn't The First Instance Of A Lawsuit Against OpenAI By A News Publisher
In December 2023, the New York Times initiated legal action against OpenAI and its financial supporter, Microsoft, claiming that they had "copied" the publisher's articles and other materials to train their AI models, a similar accusation previously made by ANI.
Subsequently, OpenAI issued a response to The New York Times, alleging that the publication employed “deceptive prompts that contravened OpenAI's terms of use” in an attempt to manipulate ChatGPT.
