Apple Faces ₹1.58 Lakh Crore Lawsuit Over Alleged App Store Monopoly

A significant legal action has been initiated against Apple in the United Kingdom, alleging that the company is taking advantage of its dominant position in the market by enforcing a 30 percent commission fee on app developers through its App Store. This lawsuit, supported by approximately 20 million users of iPhones and iPads, asserts that the practices of the technology giant have led to an overcharge of British consumers amounting to as much as 1.5 billion pounds ($1.8 billion), which is roughly equivalent to Rs. 1.58 lakh crore.

Legal Allegations Against Apple

Dr Rachael Kent from King's College London has initiated legal proceedings against Apple, alleging violations of UK and European competition laws. The lawsuit contends that Apple has established a monopoly in the app distribution market by limiting iOS users to downloading applications exclusively from the App Store and imposing significant commissions on developers' sales, as reported by Reuters. This legal action encompasses 19.6 million users in the UK who may have overpaid for applications or in-app purchases from October 2015 to November 2024. Under UK law, these individuals are automatically included in the claim unless they opt-out.

Kent asserts that the App Store, which was initially designed to facilitate app distribution, has effectively become the sole option for millions of iOS users. The lawsuit charges Apple with obstructing the development of alternative platforms that could provide consumers with more favourable options. Kent argues that Apple's monopolistic practices stifle competition, ultimately disadvantaging users.

Apple's Response

Apple has denied the allegations, characterizing the lawsuit as baseless. The company asserts that its commission rates are in line with those of other digital platforms. Furthermore, it highlights that 85 per cent of applications are available for free, and numerous developers take advantage of a reduced commission rate of 15 per cent.

The trial is currently in progress at the Competition Appeal Tribunal and is anticipated to continue for seven weeks. This case is part of a broader array of legal challenges that Apple is encountering worldwide regarding its App Store policies. As reported by Reuters, Apple is also facing a separate £785 million lawsuit in the UK related to developer fees and has recently been penalized €500 million ($538 million) by the European Commission for similar concerns.

Apple's Monopoly 

Kent, the plaintiff in this case, asserts that Apple's practices have resulted in "exorbitant profits" by stifling competition within the app distribution sector. She contends that Apple's monopoly allows it to enforce restrictive conditions on developers and impose high fees, costs that are ultimately borne by consumers.

Conversely, Apple argues that these fees are indicative of the significant advantages that developers receive from the iOS ecosystem. Marie Demetriou, the company's attorney, remarked that Kent's lawsuit fails to acknowledge Apple's intellectual property rights, characterizing the allegations as an effort to appropriate property rights under the pretence of promoting competition. The trial is anticipated to include testimony from Apple's chief financial officer, Kevan Parekh, later this week.
