Madras High Court Rejects Netflix India's Plea to Dismiss Dhanush's Copyright Claim in Nayanthara Documentary Case

On Tuesday, the Madras High Court dismissed Netflix India's plea to reject Dhanush's copyright claims related to the documentary Nayanthara: Beyond the Fairytale. The trial of the copyright case began last week at the High Court, as confirmed by Live Law.

Court Rejects Netflix India's Plea

Live Law reported on X (formerly Twitter) that the Madras High Court denied Netflix India's request to dismiss the copyright lawsuit filed by Dhanush. The suit claims that footage from the film Naanum Rowdy Dhaan was used in the documentary without Dhanush’s no-objection certificate (NOC). The court wrote, “#MadrasHC DISMISSES Netflix India's Application To Reject copyright suit filed by #Dhanush against #NetflixIndia, #Nayanthara, #VigneshSivan and their production company for unauthorisedly using footage from #NaanumRowdyDhaan in the Netflix documentary.”

The judge also indicated that the interim injunction petition filed by Dhanush’s company, Wunderbar Films, will be heard on February 5. Netflix contended that the image of Nayanthara and Vignesh Shivan from the film was uploaded in 2020, but no action was taken at that time. They also claimed that the lawsuit was filed a week after the documentary's release, questioning its urgency.

Dhanush's legal team countered that an email was sent when the documentary's trailer was released, objecting to the footage used, but no response was received. They argued that the costumes and hairstyles in the footage also rightfully belonged to the production house.

Background of the Case

In November of the previous year, Dhanush's Wunderbar Films Private Limited filed a suit against Nayanthara, Vignesh, and their production company Rowdy Pictures Private Limited. The lawsuit alleges that footage from Naanum Rowdy Dhaan was used without permission in the Netflix docu-drama. Dhanush’s company has also applied to the High Court for approval to sue Los Gatos Production Services India LLP, Netflix's content investment arm in India.
