Kim Kardashian Faces Lawsuit for Wrongfully Using NY Man’s Image in Death Row Post

A New York man has filed a lawsuit against Kim Kardashian after she inadvertently used his photograph in place of that of a death row inmate. Both the man and the inmate are named Ivan Cantu.
Prior to Cantu's execution, Kardashian posted on social media regarding the death penalty, calling for reforms in the criminal justice system. However, she mistakenly used a photo of a different Ivan Cantu, a project manager from Westchester, instead of the intended individual. This post was disseminated on Instagram, where Kardashian boasts millions of followers.
The project manager, Cantu, subsequently filed a lawsuit in Los Angeles Superior Court against Kardashian, asserting that he has endured "hatred, contempt and/or ridicule" since the error in her Instagram post. He further stated that the incident has caused him significant anxiety and emotional distress, as reported by NBC News. Cantu is now seeking unspecified damages, claiming that his reputation has been adversely affected.

Kardashian's attorney, Michael Rhodes, stated that the celebrity made an "innocent error" in her post dated February 28, 204, while attempting to highlight her "longstanding dedication to the cause of criminal justice reform." In her message, Kardashian wrote, "The State will execute Ivan Cantu in 2 days. Please sign the petition to demand that Colin County DA Greg Willis request to withdraw the execution date," accompanied by a black-and-white image of Cantu and a link to a moveon.org petition.
Rhodes noted that the image was "removed almost immediately" after Kardashian recognized her error. Cantu's attorney, Greg Sobo, emphasized that Kardashian should be acutely aware of the "influence of social media." "For too long, we have witnessed social media inflict severe harm on innocent individuals," Sobo remarked in a statement reported by the New York Post.
"Social media is frequently misused to intimidate the innocent, provoke harm, and damage our communities," he continued. "Just as those who inflict physical harm should face consequences, individuals who cause harm to innocent victims through social media must also be held accountable."
Characterizing Cantu as a father of two and a "very private family man," Sobo indicated that his client was grieving at the time of the post. "Mr. Cantu’s privacy was violated during a critical and sensitive period, resulting in a profound trauma that will endure for a lifetime," Sobo stated.
He further mentioned that he attempted to reach out to Kardashian’s team several times without success before ultimately pursuing legal action.
Texas inmate Cantu, who was charged with the fatal shootings of two individuals, including his cousin, was executed by lethal injection on February 28 of the previous year. He consistently maintained his innocence, claiming that he was wrongfully accused based on unreliable testimony and dubious evidence. Cantu was executed at the state penitentiary in Huntsville for the murders of his cousin, James Mosqueda, 27, and Mosqueda’s girlfriend, Amy Kitchen, 22, in November 2000.
