Kimberly Marasco, an artist from Florida, has launched a significant legal challenge against Taylor Swift and her production company through a copyright infringement lawsuit filed in April 2024. Marasco is seeking over $7 million in damages, asserting that the "creative elements" present in Swift's songs and music videos have been appropriated from her work without permission or acknowledgement, as reported by Newsweek.
Currently, Judge Aileen Cannon has dismissed the "Anti-Hero" singer from the lawsuit without prejudice. This decision came after the Florida artist failed to serve the lawsuit within the required timeframe last month. Nevertheless, this dismissal does not absolve Swift entirely, as the allegations against her production company, Taylor Swift Productions, remain active, allowing Marasco the opportunity to refile the lawsuit in the future.
Taylor Swift's lawyers filed to dismiss the copyright infringement lawsuit
In response to the lawsuit, attorneys representing Swift submitted a motion to dismiss on January 21, arguing that over 50% of the allegations in Marasco’s official complaint are “time-barred” according to legal standards. Should the case be dismissed and Taylor Swift Production exonerated, Swift intends to pursue an appeal or refile the case. Additionally, she has proposed that all parties involved meet to discuss a potential resolution.
The motion to dismiss, filed by attorneys Aaron S. Blynn and Katherine Wright Morrone, asserted that Kimberly Marasco’s claims are “entirely unfounded, and her ‘final opportunity’ to state a claim is unsuccessful.”
In response, the plaintiff stated that while she may not be a widely recognized national author, she has created original works that are distinct and not derived from other sources. She emphasized her efforts to protect these works, expressing her expectation to receive the same legal protections as any other creator, regardless of their level of fame.
Copyright infringement protocols
The allegations that Kimberly is pursuing "must be submitted within three years of the plaintiff becoming aware of the purported infringement," as reported by Newsweek. Marasco's lawsuit was lodged in April 2024. The legal representatives for Swift's production company indicated that according to the established timeline, Kimberly is only permitted to legally pursue claims that she became aware of after April 2021. Nevertheless, her lawsuit references albums such as "Lover," "Folklore," and "Evermore," all of which were released before 2021.
Plaintiff doesn't back down
Marasco submitted an additional response on Friday to support her assertions, arguing that she did not possess any Taylor Swift albums as she exclusively listened to alternative rock music.
In her statement, she remarked, “The fact that Taylor Swift is a highly recognized artist does not imply that the Plaintiff was familiar with the particular lyrics she performed upon the release of her albums.”

Marasco contended that her investigation into the purported similarities between her work and that of the global pop star commenced only after she attended Swift’s record-breaking Eras Tour in 2024. It was only upon uncovering the alleged “infringement” that the plaintiff began to explore the acclaimed singer’s albums, stating that there were numerous songs to examine.
In response, Blynn and Wright Morrone asserted that Marasco should have been cognizant of the claims, as Taylor’s albums had received extensive coverage from news and media outlets. They further maintained that these musical works are readily accessible on streaming platforms and have enjoyed significant popularity both domestically and internationally.
