NGT Issues Notice to Government Over Breach of Vehicle Ban in Delhi Pollution Crisis

In light of the severe pollution crisis in Delhi, the state government has received a notification from the National Green Tribunal (NGT) regarding the use of older petrol and BS 4 diesel vehicles by officials. This notice was issued as the national capital remains under the Graded Response Action Plan (GRAP) Stage 4 measures, which were enforced by the Commission for Air Quality Management (CAQM) starting December 16, due to a rise in air quality index (AQI) levels. The implemented measures include a prohibition on the operation of BS 3 petrol and BS 4 diesel vehicles, along with other commercial vehicles.

The NGT has requested an explanation from the Delhi government concerning the use of prohibited petrol and diesel vehicles by certain officials during the GRAP Stage 4 restrictions. Commuters who violate the vehicle ban in Delhi face penalties of up to ₹20,000. Previously, the NGT had prohibited the use of petrol vehicles older than 10 years and diesel vehicles exceeding 15 years in age in Delhi to mitigate pollution levels. Many government vehicles currently in use are outdated and contravene the NGT's regulations.

The notice from the NGT addressed to the Delhi government states, "Counsel for the applicant (MLA), referring to annexure A2, which is a list of 107 vehicles of the Delhi government, has pointed out that several diesel and petrol vehicles belonging to the government of NCT of Delhi have surpassed their operational lifespan of 10-15 years, yet they continue to be in use." The Delhi government presently operates approximately 3,000 official vehicles. The NGT is scheduled to hear this matter on February 20 of the following year.

Delhi vehicle ban: Which cars are allowed to ply

The vehicle prohibition in Delhi during GRAP Stage 4 specifically targets cars that possess BS 3 petrol or BS 4 diesel emission certificates. All other types of vehicles are not subject to this restriction. Additionally, CNG vehicles that adhere to older emission standards are permitted to operate. The limitations do not extend to electric vehicles or those utilized for essential services.
